Use of MacZ Software BetterCalc 2.0 ("BetterCalc") is subject to the following terms and conditions. If you (the "User") proceed with the installation of BetterCalc (the "Software") you are agreeing to be bound by the terms of this License.
1. Ownership
User acknowledges and agrees that the Software and all of its parts, all elements of the BetterCalc bundle, the BetterCalc source code and the MacZ Software BetterCalc name are copyright 1999 - 2000 MacZ Software unless stated otherwise.
2. License
a. MacZ Software grants the User a royalty-free, limited trialware license, for personal, non-commercial use only. If or when the User so wishes, he or she can purchase a license for the complete, non-crippled version of the Software. Licenses include single-user, site license and world-wide license. The licenses must be used exactly as described in the Documentation of the Software.
b. Such grant does not include and specifically excludes the right to: (i) sub license, modify, or translate the Software, (ii) distribute or provide the Software to or for the use of any third party without express permission or the proper license, (iii) merge the Software, or any updates thereto, with any third party product without express permission or a proper license, (iv) reverse compile, reverse assemble, or otherwise reverse engineer or re-engineer the Software.
3. Disclaimer of Warranty
The Software is provided to User "AS IS", WITHOUT WARRANTY OF ANY KIND, IMPLIED OR EXPRESSED, AND DISCLAIMS ALL WARRANTIES, IMPLIED OR EXPRESSED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
4. Limitation of Liability
MACZ SOFTWARE SHALL HAVE NO LIABILITY WHATSOEVER FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES ARISING FROM THE USE OF THE SOFTWARE, OR FROM THE SUPPORT SERVICES, IF ANY, PROVIDED BY MACZ SOFTWARE, OR OTHERWISE UNDER THIS AGREEMENT. USER RELEASES MACZ SOFTWARE AND THE AUTHOR(S) OF THE SOFTWARE FROM ALL LIABILITY FROM LOST PROFITS, DIRECT DAMAGES, OR PERSONAL INJURY AND/OR PROPERTY DAMAGE, OR COMPUTER DOWNTIME ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY INACCURACIES OR MALFUNCTIONS IN THE PRODUCT, OR FROM ANY OTHER CAUSE.
5. Term
a. This License is effective until terminated by either party. User may terminate this License at any time by destroying the Software and all copies and installations thereof. This License will terminate immediately without notice from MacZ Software if User fails to comply with any provision of this License.
b. Upon any termination, User will make no further use of the Software and will destroy all copies thereof.
